OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
ELIGIBILITY: The “Red Bull Festival Run” (the “Contest”) begins on March 1, 2018 at 12:01 a.m. Pacific Time (PT) and ends on April 30, 2018 at 11:59 p.m. PT (“Promotion Period”). The time shall be determined by Sponsor’s timekeeping systems. Sponsor shall have the sole discretion in determining the timeliness of any action or inaction related to this Contest. All times mentioned in these Official Rules shall be Pacific Time unless expressly noted otherwise.
The Contest is open to individuals who (i) are legal residents of California, Oregon, and Washington and (ii) who are at least eighteen (18) years[LNE1] old and the age of majority in their jurisdictions of residence as of the date of entry. Entrants must be at least twenty-one (21) years old to be eligible to win the Grand Prize (as described below). Void where prohibited. Employees of Red Bull North America, Inc. (“Sponsor”), Chevron Corporation (“Prize Provider”), Live Nation Worldwide, Inc. (“Live Nation”), and their parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Contest (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or those living in the same household) of Sponsor, Prize Provider, or any Sponsor Affiliates are not eligible to participate in the Contest. Contest is subject to all applicable federal, state, and local laws.
TO ENTER: To enter the Contest, complete the following steps during the Promotion Period:
1. Either:
a. Visit the Red Bull Festival Run Lollapalooza® stage at redbull.com/lolla18; or
b. locate and scan the Contest Snapcode and follow the instructions to navigate to the website (standard data and messaging rates apply).
2. Following all posted instructions, you must individually and alone, without the aid of any third parties or third-party software or “hacks”, play the Lollapalooza Festival Run game to compete for the most points on the leader board by (A) collecting different cans; (B) gathering different items a consumer will need at a festival (e.g., sunglasses, hat, camping gear etc.); and (C), as long as your power gauge is filled, you can continue playing the Festival Run game and set your score. If you begin missing items, your character will not be able to continue;
3. After completing a run, you may play again to attempt to achieve a higher score, or you may register your score on the leaderboard by following all posted instruction, entering all the required information, and agreeing to the terms and conditions.
Consumer may enter as many times as they wish. One (1) grand prize winner will be chosen based on finishing the Contest Period with the most points; one (1) secondary prize winner will be randomly selected from among all other registered participants.
Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that it believes did not comply with these Official Rules, or that is not consistent with the spirit or theme of the Contest. Sponsor is not responsible for lost, late, misdirected entries or entries not received regardless of cause. In the event of a dispute over who submitted an entry, Sponsor will determine the identity of the entry in its sole discretion. Entries become the property of Sponsor and will not be returned. By entering, attempting to enter, or otherwise participating in this Contest, you agree to be bound by these Official Rules.
WINNER SELECTION: On or about the conclusion of the Promotion Period, the registered user with the most points received for navigating their way through the festival grounds in the Festival Run game (accounting for ties for most points) will be awarded the Grand Prize. Scores are verified and finalized at Sponsor’s sole discretion. All potential winners are subject to verification of eligibility and compliance with these Official Rules.
In the event of a tie for the most points, the first player to achieve and register the score for the most points will be declared the winner. Intentional or unintentional manipulations of connection speed or any other game play alterations are strictly prohibited and will result in immediate disqualification from Contest.
In addition to the Grand Prize winner, there will be a Secondary Prize winner selected at random from among all other registered scores. The Secondary Prize winner will be verified and finalized at the Sponsor’s sole discretion. All entries into the Contest will be considered as potential winners and will be subject to verification of eligibility and compliance with these official rules.
GRAND PRIZE: The verified Winner who places first on the leaderboard at the conclusion of the Contest will receive the following prizes:
· Grand Prize: A prize package for a trip for two (2) to Lollapalooza (the “Festival”) in Grant Park Chicago, Illinois, August 2–5, 2018. Must be at least twenty-one (21) years old to be eligible to win the Grand Prize.
o Includes:
§ 4-Day Platinum Tickets to Lollapalooza for two (2), with admittance to Grant Park for all four days of Lollapalooza with exclusive perks & amenities, including access to Platinum Viewing Areas. Fees Included.
o A travel package comprised of:
§ Round-trip economy cabin air transportation for the Winner and one (1) guest from the major airport nearest to the Winner, as determined in Sponsor’s sole discretion, to the major airport nearest to Chicago, Illinois, as determined in Sponsor’s sole discretion.
§ Lodging for five (5) nights (single room, double occupancy), in a hotel to be determined by Sponsor in its sole discretion;
§ Premium Round-trip ground transportation from the major airport selected by Sponsor to the Festival grounds.
§ Premium transportation for duration of stay
§ Food and drink per diem allowance
§ Tickets for official Lollapalooza after-parties
§ Assorted official festival merchandise
§ Premium Spa treatment
§ Live Broadcast Backstage tour
§ Customized gift bag with festival essentials
§ Additional elements, TBA
o Total Approximate Retail Value (“ARV”) of all prizes: $19,700
SECONDARY PRIZE: A secondary winner will be chosen at random [LNE2] at the Sponsor’s sole discretion. All non-Grand-Prize winning eligble entries into the Contest will be considered as potential Secondary Prize winners and will be subject to verification of eligibility and compliance with these Official Rules.
· Secondary Prize: A prize package of a trip for two (2) to the Lollapalooza (the “Festival”) in Grant Park Chicago, Illinois, August 2–5, 2018.
o Includes: 4-Day General Admission tickets for two (2). ARV: $1,500
o A travel package comprised of:
§ Round-trip economy cabin air transportation for the Winner and one (1) guest from the major airport nearest to the Winner, as determined in Sponsor’s sole discretion, to the major airport nearest to Chicago, Illinois, as determined in Sponsor’s sole discretion. ARV: $1,500
§ Lodging for four (4) nights (single room, double occupancy), in a hotel to be determined by Sponsor in its sole discretion; ARV: $2,500
§ Round-trip ground transportation from the major airport selected by Sponsor to the Festival Grounds. ARV: $150
o Total ARV of all prizes: $5,650
The approximate retail value of all prizes to be awarded in this Contest is $25,350. All prizes are awarded “AS IS.” Neither Sponsor, Prize Provider, nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Contest or any prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prizes consist only of the items listed, are non-transferable and non-assignable, with no cash redemption or substitution except at Sponsor’s sole discretion. Ticket passes will be held at Will Call at the Event venue and must be redeemed by the verified winner. Prize winner may be required to show a valid photo identification, valid driver’s license, or other acceptable government-issued identification to verify identity and redeem ticket prize. Prizes are subject to terms, conditions, expiration dates, and restrictions imposed by the manufacturer/issuer of the prize. No refund or compensation will be paid in the event of the cancellation or delay of any portion of the ticket prize, or any portion thereof. Sponsor will not be liable if the event, or any portion of it, is cancelled or delayed. Sponsor and Prize Provider may, in their sole discretion, attempt to reschedule for a future trip/event. The terms and conditions of the event tickets may govern if the event is cancelled due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Sponsor and Prize Provider are not responsible for, and will not replace, lost, mutilated, or stolen event tickets, vouchers, wristbands, or certificates. Exact details, including seat locations, shall be determined in the sole discretion of Sponsor and Prize Provider. Federal, state, and local taxes on prizes, if any, and any other costs, fees and expenses not listed above as specifically included as part of the prize are thse sole responsibility of winner.
Travel-Related Prizes: All travel arrangements must be made through Sponsor’s agent. Any other costs and expenses associated with prize acceptance and use not specifically provided herein (such as security fees, gratuities, luggage fees, meals and transportation, and incidental charges) are the responsibility of the winner(s). Ground transportation may be provided in lieu of air transportation if winning entrant resides within a 100-mile radius of destination, and no compensation or substitution will be provided for difference in value. Guest of each winner must meet Contest eligibility requirements. Each winner and their guest must possess and show valid travel documents, prior to departure (e.g., passport, visa, valid driver’s license, or other acceptable government-issued identification), and must sign a Release of Liability/Publicity and any other documents provided to him or her prior to ticketing. Once airline tickets have been ticketed, no changes will be permitted. Sponsor will determine airline, airports, flight itinerary, and hotel in its sole discretion. Travel and accommodation restrictions, conditions, and limitations may apply. Neither Sponsor nor Prize Provider will replace any lost, mutilated, or stolen tickets or travel vouchers.
WINNER NOTIFICATION/RELEASES: The potential prize winners will be notified after the winner selection on or about May 1, 2018. Sponsor may require winner(s) to complete, sign, notarize and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, which may require a social security number, to be returned within forty-eight (48) hours of the date and time on the notification. At Sponsor’s discretion, winners may be required to produce picture or some other form of proper identification to claim any prize. Sponsor and Prize Provider reserve the right to substitute any prize with prize of equal or greater value. If a potential winner cannot be contacted, or fails to timely respond to Sponsor’s notification, the next potential winner with the most points posted to the Leaderboard will be contacted to award the Grand Prize; an additional random drawing will be held to award the Secondary Prize. The Sponsor will continue to select additional potential winners until the Grand Prize and Secondary Prize is awarded. If by reason of printing or other error, more prizes are claimed than the number of prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of prizes in the relevant category. Under no circumstances will more than the advertised number of prizes be awarded.
PUBLICITY & MARKETING: Submission of an entry in the Contest constitutes permission to the Sponsor to use entrants’ name, identity, title, likeness, distinctive appearance, physical likeness, image, portrait, picture, photograph (whether still or moving), screen persona, voice, vocal style, statements, gesture, mannerism, personality, performance characteristic, biographical data, signature, and any other indicia or imitation of identity or likeness for purposes of advertising and trade, in any medium, without further notice, approval, or compensation, unless prohibited by law. Submission of contact information in connection with this Contest (whether or not required), including, without limitation, mailing address, phone number, email address during entry constitutes permission for Sponsor to use entrant’s personal information for purposes of administration of the Contest. You also may opt-in to be added to Sponsor’s customer database and to permit Sponsor to contact you in the future for promotional and other reasons. You may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy (located at policies.redbull.com/policies/RedBull.com_US/201711020739/en/privacy.html) or as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s e-mails). The information you provide will only be used in accordance with Sponsor’s Privacy Policy.
NO LIABILITY & INDEMNIFICATION: By entering this Contest, you agree to release, discharge and hold harmless Sponsor, Prize Provider, Sponsor Affiliates, Live Nation, Lollapalooza, LLC, Snap, Inc., and their respective directors, officers, employees, agents and assigns (the “Released Parties”) from any claims, losses, and damages arising out of, or relating to, your participation in this Contest or any Contest-related activities (including, without limitation, the concert) and the acceptance and use, misuse, or possession of any prize awarded hereunder (including, without limitation, any misrepresentation made by the you in connection with the Contest; any non-compliance by the you with these Official Rules; claims brought by persons or entities other than the parties to these Official Rules arising from or related to your involvement with the Contest; acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; any malfunction, error or other problem arising in connection with the collection, processing, or retention of entry information; or any typographical or other error in the printing, offering or announcement of any prize or winner). The foregoing includes, without limitation, any claim for personal injury, property loss or damage, or death arising in any way in connection with the Contest.
OTHER TERMS: Decisions of Sponsor on all matters related to the Contest are final and binding. Sponsor reserves the right to cancel or modify the Contest for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Contest, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Sponsor, in its sole discretion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY APPLICABLE LAW.
GOVERNING LAW & MANDATORY ARBITRATION: Any disputes arising under this Contest and/or these Official Rules will be governed by relevant U.S. federal statutes and regulations and the internal laws of the State of California. Sponsor, Prize Provider, and each entrant agree that any such claim or dispute between the parties, or between a party and any agent, employee, successor, or assign of the other, related to this Contest and/or these Official Rules (including the applicability of this arbitration clause) shall be resolved by binding arbitration administered by the JAMS under its rules and procedures in effect when the claim is filed. The rules and procedures and other information, including information on fees, may be obtained from JAMS’ website (www.jamsadr.com) or by calling JAMS at 949-224-1810. Any award by the arbitrator(s) may be entered as a judgment in any court having jurisdiction.
RIGHT TO DISQUALIFY: Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected; if the individual fails to comply with any requirement of participation or with any provision in these Official Rules; if the individual’s behavior or communication at any point is disruptive, may or does cause damage or to any person, property, or reputation of Sponsor; or is otherwise not in accordance with all applicable laws and generally accepted social practices as determined in Sponsor’s sole discretion.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
